Information on Personal Data Processing
Under the provisions and for the purposes of Article 10 of legislative decree 196/2003 - Protection of Personal Data Privacy (Privacy Code) -, Mercuri Urval S.r.l., with registered office in Milan, via Turati n. 29, informs as Owner all concerned of the following:
1. Processing Procedure and Purpose
All data submitted by candidates will be handled and saved - also by use of electronic media - with the sole purpose of conducting an objective and qualified assessment of the individual in respect of the job for which a selection or an in-depth assessment of the personnel is being held.
For the same purpose the candidates´ personal data can be saved by subjects indicated as "Professional Referents".
On receiving a candidate´s CV, Mercuri Urval´s e-mail system will automatically reply to the sender´s e-mail address acknowledging the receipt of the curriculum vitae.
2. Data Submission
The submission of data by the candidate is absolutely optional. Default in providing such personal data by the candidate will anyway prevent Mercuri Urval from taking the candidate into consideration within the recruitment and selection or the in-depth assessment process.
3. Confidential Data
Candidates are invited not to indicate any confidential personal information (particularly related to racial or ethnical group, religious and philosophical beliefs, political opinion, adherence to parties, trade unions, religious, philosophical or political organisations, nor personal data related to health status and sexual life). Any confidential information will be immediately deleted unless a written consent for the treatment is given by the candidate - after carefully reading the present information - to Mercuri Urval and its client company.
4. Communication, Knowledge, Transmission and Spreading of Data
For the purpose indicated at point 1 and for what is strictly required by the selection or in-depth assessment process, the candidate´s personal data can only be transmitted to:
- Clients by whom Mercuri Urval has been appointed to run a selection or an in-depth assessment project;
- its own subsidiaries or controlled companies.
The following subjects can become acquainted with the data provided:
- the person responsible for the Information Systems in the office of Milan via Turati n. 29;
- the persons in charge with the treatment of personal data in the offices of Milan, via Turati n. 29, and Rome, viale dell´Esperanto 71;
- the persons, also external to Mercuri Urval S.r.l., in charge with the management and maintenance of electronic instruments, as appointee for the treatment of data.
For the reasons mentioned under point 1, personal data may also be transmitted abroad, both to countries belonging to the EU and to countries outside the EU, under the provisions of the article 28, legislative decree 196/2003. However, the Candidate´s personal data will not absolutely be spread. Mercuri Urval will store the data for no longer than 12 months.
5. Candidate´s Rights
Concerning their personal data, all interested parties shall at any time be able to exercise the rights confered by article 7, Legislative decree 196/2003, entirely quoted below:
"Art. 7 - Right of the interested parties to have access to personal data and other rights.
As far as the treatment of personal data is concerned, the interested party has the right:
1. to obtain confirmation of the existence of his/her own personal data, even if not yet recorded, and to have them communicated in a comprehensible form.
2. to be informed about:
a) the source of the personal data;
b) the logic and the purpose of data treatment;
c) the logic applied to data treated by means of electronic tools;
d) the identification of the Owner, the responsible persons and the appointed representatives as by article 5, paragraph 2;
e) the subjects or the categories of subjects to whom the personal data can be transmitted or who can get to know them as appointed representatives or responsible persons.
3. to obtain:
a) the updating, correction or - if interested - integration of data;
b) the deletion, conversion into anonymous form or restriction of such personal information if handled in breach of the law, including data that must not necessarily be stored for the purposes of collection or handling;
c) the statement that all operations mentioned under paras. a) and b), as well as what concerns their contents, have been notified to the recipients of such data, except when this performance is impossible or requires resources clearly disproportionate to the right being preserved.
4. to oppose, either completely or in part:
a) for legitimate reasons, to the handling of data regarding him/herself, although relevant for the purpose of the collection;
b) to the handling of personal data with the purpose of submitting commercial information, advertising or direct-sales material, or for carrying out market surveys or interactive commercial communication.
6. Owner and Responsible of the Treatment
Mercuri Urval S.r.l. based in Milan, via Turati n. 29, is in charge of the data treatment. The responsible of the treatment is the Information System Responsible of the office in Milan, via Turati n. 29, also nominated for the purposes mentioned under article 7, legislative decree 196/2003.
